    Firma ExcelAire (wlasciciele tego Legacy) wyslali raport do Brazylijskiej policji prowadzacej sledzctwo w sprawie tej katastrofy. 154-ro stronicowy raport opisuje zdarzenia minuta po minucie i konczy konkluzja ze nie ma zadnej watpliwosci ze glowna wine za ten wypadek ponosi Brazylisjka ATC. ExcelAire rowniez narzeka ze do tej pory nie zostaly przeprowadzone stsosowne testy TCAS i RMU - z ktorymi Embraer mial juz poprzednio klopoty. Miedzynarodowa Federacja Kontrolerow (IFATCA) rowniez wina za ten wypadek obwinia przestarzale oprogramowanie ATC uzywane w Brazyli.

    Ktos to przetlumaczyl z portugalskiego na angielski, tlumaczenie jest strasznie kiepskie ale i tak mozna jak tako zrozumiec.

    4:35 - ATCer Felipe Santos dos Reis authorized the flight plan

    * Accusation: Reis transmitted an incomplete authorization to SJC's tower. He omitted the altitude changes that were supposed to be performed during the flight, which contributed to the accident



    14:54 - The pilots Jan Paladino and Joe Lepore took off with the Legacy N600XL

    * Accusation: Despite knowing about the foreseen level changes in the flight plan, the pilots abstained of asking for any clarification or complement of the authorization



    15:55 - The Legacy enters the Brasília-Manaus airway flying at 37000 ft.

    * Accusation: ATCer Jomarcelo Fernandes dos Santos, who was responsible for the sector in which the Legacy was flying, did not request the level change to 36000 ft, which was foreseen in the flight beyond this point



    16:01 - The transponder signal of the Legacy disappears from the radar screen of Cindacta 1

    * Accusation: While Paladino and Lepore were testing some systems, they accidentally deactivated the transponder. The pilots didn't pay the necessary attention to the equipment's functioning by ignoring the warning message of deactivation
    * Accusation: ATCer Santos ignored the warning message of inoperative transponder given by the system and did not contact the pilots, so that they could verify the equipment



    16:17 - Lucivando Tibúrcio de Alencar replaces his colleague Santos

    * Accusation: Santos should have informed his substitute about the problem with the aircraft, but, instead, confirmed that the Legacy was at the foresseen altitude



    16:27 - Ten minutes afterwards, Alecar tries the first contact with the Legacy through radio

    * Accusation: Like his predecessor, the ATCer ignored the information that the transponder was inoperative and took too much time to contact the Legacy



    16:30 - The ATCer Leandro José Santos de Barros takes a seat next to Alencar in the condition of an assistant

    * Accusation: Sgt. Barros also ignored the information of inoperative transponder and did not take any measure



    16:34 - The ATCer Alencar continues to try to communicate with the aircarft

    * Accusation: Alencar should have tried other radio frequencies, in order to establish contact, but kept insisting on the same frequency without success



    16:48 - The pilots started a series of attempts of communication with Cindacta 1

    * Accusation: After trying twelve times with no sucess, Lepore and Paladino should have taken the necessary measures for communication failure, which consists in activating a special code in the transponder



    16:53 - Alencar made his last attempt of communication using all frequencies

    * Accusation: The ATCers Alencar and Barros should have informed Cindacta 4, center which was controlling the GOL aircraft, about the transponder problems and about the communication failure.



    16:57 - Both planes collide mid-air

    * If Cindacta 4 controllers had received the informations from Cindacta 1, they could have requested GOL's 737 to perform an evasive maneuver
